1. Scope

These Terms and Conditions apply to all orders placed through and use of the STMNT online store.

The operator of the online store and contractual partner of the customer is:

By placing an order, the customer agrees to these Terms and Conditions in the version applicable at the time of purchase.

2. Products and Conclusion of Contract

The presentation of products in our online store constitutes an invitation to place an order.

By completing the checkout process, the customer submits a binding offer to purchase the selected products.

After placing an order, the customer will receive an electronic order confirmation. STMNT reserves the right to reject or cancel an order, particularly in cases of product unavailability, obvious pricing errors, payment issues or suspected misuse.

Customers are responsible for providing complete and accurate information when placing an order.

3. Product Information

STMNT makes every reasonable effort to display and describe products as accurately as possible.

However, colours and other visual details may vary slightly depending on the customer's screen, device settings, materials and manufacturing processes.

Minor and commercially reasonable variations do not constitute a defect provided that the essential characteristics of the product are not affected.

STMNT reserves the right to modify products, designs, prices and availability or discontinue products at any time.

4. Prices and Payment

All prices are displayed in the currency stated in the online store.

The price shown at the time the order is completed is the applicable purchase price.

Any additional shipping costs will be displayed before the customer completes the order.

Depending on the destination country, additional taxes, customs duties or import charges may apply. Unless expressly included during checkout, such charges are the responsibility of the customer.

Available payment methods are displayed during checkout.

Payment is due according to the payment method selected by the customer.

5. Shipping and Delivery

Orders are delivered to the shipping address provided by the customer during checkout.

Unless expressly stated otherwise, delivery times shown in the online store are estimates and are not guaranteed delivery dates.

Delivery may be delayed due to shipping carriers, customs processing, force majeure or other circumstances outside STMNT's reasonable control.

Customers are responsible for providing a correct and complete delivery address.

6. Returns and Right of Withdrawal

STMNT generally provides customers with a 14-day return period starting from the date the order is received, subject to the conditions and statutory exceptions described in our Refund Policy.

For consumers within the European Union, and in other jurisdictions where mandatory withdrawal rights apply, all mandatory consumer rights remain unaffected.

Where a statutory right of withdrawal applies, the customer may exercise that right within the applicable legal period without providing a reason.

Returned products must generally be unworn, unused and, where reasonably possible, returned with their original tags and packaging.

Certain products, particularly goods made to the customer's specifications or clearly personalised products, may be excluded from returns or statutory withdrawal rights where permitted by applicable law.

7. Return Shipping Costs

Unless otherwise stated or required by applicable law, customers are responsible for the direct costs of returning products when exercising a voluntary return or withdrawal.

Different rules may apply where a product is defective, damaged or incorrectly delivered.

8. Damaged, Defective or Incorrect Products

Customers are encouraged to inspect their order after receiving it.

If an item is defective, damaged or incorrectly delivered, please contact us as soon as possible at kontakt@stmnt.ch.

Any mandatory statutory warranty and consumer rights remain unaffected.

9. Intellectual Property

Unless otherwise stated, all content available through STMNT, including trademarks, logos, graphics, photographs, videos, product designs, text and other materials, is owned by STMNT or used with appropriate authorisation.

Content may not be reproduced, modified, distributed, published or commercially exploited without prior permission from the relevant rights holder.

Use of the online store does not grant customers any rights to STMNT's or any third party's trademarks, designs, copyrights or other intellectual property.

10. Shopify and Third-Party Services

The STMNT online store is technically operated using Shopify.

Shopify provides the e-commerce infrastructure used to operate the store. However, purchases of STMNT products are made directly between the customer and STMNT. Shopify is not the seller of the products.

STMNT may also use third-party providers for payments, shipping, analytics and other technical services.

The processing of personal data by such providers is governed by our Privacy Policy and applicable data protection legislation.

11. Privacy

Personal data is processed in accordance with our Privacy Policy and applicable data protection laws.

To process and fulfil orders, necessary customer information may be shared with Shopify, payment providers, shipping companies and other service providers required to complete the transaction.

12. Reviews and User-Generated Content

Customers who submit reviews, photographs or other content must have the necessary rights to provide such content.

Submitted content must not violate third-party rights or contain unlawful, misleading or abusive material.

Where legally permitted, customers grant STMNT the necessary rights to display and use voluntarily submitted reviews and related content in connection with the presentation and promotion of STMNT and its products.

13. Errors and Pricing Mistakes

Despite reasonable care, the online store may occasionally contain technical errors, incorrect product information, pricing mistakes or other obvious errors.

STMNT reserves the right to correct obvious errors.

If an order is materially affected by an obvious error, STMNT will inform the customer. Any payment already received in connection with a validly cancelled order will be refunded.

14. Prohibited Uses

The STMNT online store may only be used for lawful purposes.

In particular, users may not use the store to:

• engage in fraudulent or unlawful activities;

• violate intellectual property or other rights belonging to STMNT or third parties;

• distribute viruses, malware or other harmful software;

• collect personal information about other users without authorisation;

• attempt to circumvent security measures;

• interfere with the proper operation of the website;

• use automated systems in an abusive or unauthorised manner.

STMNT reserves the right to restrict access to the online store in cases of misuse, to the extent permitted by law.

15. Liability

STMNT is liable in accordance with applicable mandatory law.

To the extent permitted by applicable law, STMNT is not liable for damage resulting from improper use of products, circumstances attributable to the customer or events outside STMNT's reasonable control.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Mandatory consumer rights remain unaffected.

16. Applicable Law and Consumer Rights

These Terms and Conditions and contractual relationships with STMNT are generally governed by the laws of the Principality of Liechtenstein, unless mandatory applicable law provides otherwise.

For consumers residing in Switzerland, the European Union or another jurisdiction, mandatory consumer protection provisions applicable in the consumer's country of residence remain unaffected where such rights cannot legally be excluded by a choice of law.

Mandatory statutory rules regarding jurisdiction remain unaffected.

17. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in full force and effect.

The applicable statutory provisions shall apply in place of any invalid or unenforceable provision.

18. Changes to These Terms

STMNT reserves the right to update or amend these Terms and Conditions where necessary.

The version applicable to an order is generally the version in effect when the customer places that order.
